(hereinafter, the "Company", "ELS", "we", "us" or "our") and its subsidiaries and affiliates, values you as our guest or resident and recognizes that privacy is important to you. It does not apply to information collected by any third party, including through any application or content (including advertising) that may link to or be accessible from or through the Services (herein defined).
Collectively, we refer to the Websites, the Apps and our Social Media Pages, as the "Online Services" and, together with the Property Visits and Offline Interactions, the "Services." For the purposes of this Policy, "you" and "your" mean you as the user of the Services, whether you are a customer, website visitor, or another individual whose data we have collected pursuant to this Policy. By using the Services, you agree to the collection, use, and disclosure of your data as described in this Policy. If you do not agree to this Policy, please do not use or access the Services. This policy may change from time to time (see Updates to Policy). 1. TYPES OF INFORMATION WE COLLECT
We collect information about you and from you in various different ways when you interact with our Services. The types of information we collect may vary depending on which Services you use and how you interact with them, and may include the following:- Basic contact details, such as name, address, telephone number, and email address,

- Visual and audio information, such as images, video and audio data via security cameras located in common areas, such as clubhouses, at our properties,
- Any information you choose to include in communications with us, for example, when sending a message through the Services,
- Browser and device data, such as device and browser type, operating system, unique device identifier, and internet protocol (IP) address,
- Information regarding your interactions with the Service, such as app usage data, log data, data and time stamps, clickstream data, interactions with marketing emails, ad impressions,
- Analytics data received from analytics providers such as Google Analytics, and
- Preferences, enquiries and comments and any other personalized data ("Personal Preferences"), such as your interests, activities, language, purchase choices, services and amenities of which you advise us or which we learn about you.
We may deidentify or anonymize your information such that it cannot reasonably be used to infer information about you or otherwise be linked to you ("deidentified information") (or we may collect information that has already been deidentified/anonymized), and we may use such deidentified information for any purpose. To the extent we possess or process any deidentified information, we will maintain and use such information in deidentified/anonymized form and not attempt to re-identify the information, except solely for the purpose of determining whether our deidentification/anonymization process satisfies legal requirements.
If you submit any information about other people to us or our Service Providers (e.g., if you make a reservation for another individual), you represent that you have the authority to do so and you permit us to use the data in accordance with this Policy.
2. HOW WE COLLECT YOUR INFORMATION
When you use or access the Services, we collect certain categories of information about you in a variety of ways:
- Online Services. We collect information about you when you visit our Websites, make a reservation, purchase goods and services from our Websites or Apps, communicate with us, or otherwise connect with us or post to Social Media Pages, or sign up for a newsletter or participate in a survey, contest, promotional offer or webcast.
- Property Visits and Offline Interactions. We collect information about you when you visit our Properties, or use amenities and services, such as restaurants, stores and activity centers. We also collect information when you attend promotional events that we host or in which we participate, or when you provide information to facilitate an event.
- Customer Service. We collect information about you when you make a reservation, communicate with us by telephone, email, text message, chat, fax or other electronic message or contact customer service. These communications may be recorded for purposes of quality assurance and training.
We automatically collect certain information about your interaction with the Services through a variety of technologies, such as cookies, pixels, tags, and application program interfaces, including when you visit our Online Services or use our Online Services on third-party sites or platforms using one or more devices, whether or not you are logged in or registered.
- Your browser or device. We collect certain data through your browser or automatically through your device, such as your computer type (Windows or Macintosh), screen resolution, operating system name and version, device manufacturer and model, language, internet browser type and version and the name and version of the Online Services (such as the Apps) you are using. We use this data to ensure that the Online Services function properly.
- Your use of the Apps. We collect certain data when you download and use an App, such as App usage data, the date and time the App on your device accesses our servers and what data and files have been downloaded to the App based on your device number.
- Cookies. As part of offering and providing customizable and personalized services, our Online Services may use cookies to store and sometimes track information about you. A cookie is a small amount of data that is sent to your browser from a server and stored on your computer's hard drive. Several features of our Online Services require that you accept cookies in order to work properly. We often use cookies to store visitors' preferences and record session information.
- Pixel Tags and other similar technologies. We collect data from pixel tags (also known as web beacons and clear GIFs), which are used with some Online Services to, among other things, track the actions of users of the Online Services (including email recipients), measure the success of our marketing campaigns and compile statistics about usage of the Online Services.
- Analytics. We collect data through Google Analytics and Adobe Analytics, which use cookies and technologies to collect and analyze data about use of the Services. These services collect data regarding the use of other websites, apps and online resources. We use cookies in order to optimize our marketing efforts as well as those of other third parties, with regard to advertising. These cookies are shared with third parties such as advertising and social media networks, or other companies, in order for these entities to be able to yield more efficient use of available advertising inventory. For these purposes, the cookies are usually placed by the advertising networks and other media properties we work with. This functionality enables these entities to remember that you have visited our Online Services, and this information is then shared with third parties such as advertisers and data processing and targeting companies.
Cookies are also placed by other third parties, such as companies that track, measure and analyze various aspects of our web site activity in order to help us customize and improve the web site experience for visitors to our Online Services, and to provide other third parties with information about visitors to our Online Services to help optimize their marketing efforts.

3. USE OF YOUR INFORMATION
The primary goal of collecting your information is to provide you, the user, with a customized and optimized experience and to assist you in communications and completing transactions with us. We use your information for our legitimate business interests and to manage our contractual relationship with you, including, but not limited to, the following:
- Provide the Services you request. We use your information to provide Services you request, including, but not limited to:
- Carry out our obligations and enforce our rights arising from any contracts entered into between you and us, including for billing and collections.
- To facilitate payment, send administrative information, communicate emergencies, process applications for residency or membership and provide you with related customer service.
- To complete your reservation and stay, for example, ensure that your site or rental is available, send confirmation or pre-arrival messages and to provide you with information about the area and the property at which you are scheduled to visit.
- Communicate with you about services and goods according to your Personal Preferences. We use your information, such as phone number and e-mail, to send you informational and marketing communications and promotional offers about our services and our partners’, as well as periodic customer satisfaction, market research or quality assurance surveys. For the avoidance of doubt, by providing your phone number, you agree to receiving calls and messages at that number, including auto-dialed and pre-recorded message calls, about your account, billing and reservations. Standard messaging, data and call rates apply. Message frequency may vary. If you do not wish to receive such emails, mailings, telephone calls, or text messages, please follow the procedure explained in "Choices available to you regarding collection, use and distribution of your information" below. We will implement your request within a reasonable time after we receive it.
- Sweepstakes, activities, events and promotions. We use your information to allow you to participate in sweepstakes, contests and other promotions and to administer these activities. Some of these activities have additional rules and may contain additional information about how we use and disclose your information. We suggest that you read any such rules carefully.
- Business Purposes. We use your information for data analysis, audits, security and fraud monitoring and prevention (including with the use of closed circuit television, card keys, and other security systems), developing new goods and services, enhancing, improving or modifying our Services, identifying usage trends, determining the effectiveness of our promotional campaigns and operating and expanding our business activities.

In addition to the specific uses described above, we may use your information to provide you with the Services and to maintain our business relationship, including by enhancing the safety and security of our Services (e.g., troubleshooting, data analysis, testing, system maintenance, and reporting), providing customer support, sending service and other non-marketing communications, monitoring and analyzing trends, and conducting internal research and development.
4. DATA SECURITY AND RETENTION
We implement and maintain reasonable security, technical, administrative and physical measures in an effort to protect against the loss, misuse or alteration of information that we have collected from you. Unfortunately, no data transmission or storage system can be guaranteed to be 100% secure. Any information you send to us electronically, while using the Services or otherwise interacting with us, may not be secure while in transit. We retain your information for as long as is reasonably necessary for the purposes specified in this Policy. When determining the length of time to retain your information, we consider various criteria, including whether we need the information to continue to provide you the Services, resolve a dispute, enforce our contractual agreements, prevent harm, promote safety, security and integrity, or protect ourselves, including our rights, property or products.
5. TO WHOM YOUR INFORMATION MAY BE DISCLOSED
As a general rule, we will not disclose any of your information except as set forth below.
- With our affiliated or subsidiary companies in order to better serve you and to offer you worthwhile products and services.
- With professional advisors, such as auditors, law firms, or accounting firms.
- Third parties in connection with or anticipation of an asset sale, merger, or other business transaction, including in the context of bankruptcy.
- With vendors or other service providers who help us run our Services or perform other services on our behalf (e.g., e-mail delivery, mailing list management, analysis, optimization services, etc.). These companies are only allowed to retain, use and disclose your information for the specific task they've been hired to do and are required to keep your information confidential and secure.
- For legal-related purposes (if necessary), including disclosures in connection with a lawsuit or legal investigation, court order, governmental inquiry, enforcement of legal rights (e.g., contract terms, intellectual property rights, etc.), fraud investigation, safety issue, or other similar matter.
- We may also disclose information in special cases when we have reason to believe that disclosing this information is necessary to identify, contact, or bring legal action against someone who may be violating the this Policy or may be causing injury to or interference with (either intentionally or unintentionally) our rights or property, users of our Online Services, or anyone else that could be harmed by such activities. We may disclose or access information when we believe in good faith that the law requires it and for administrative and other purposes that we deem necessary to maintain, service, and improve our products and services.

7. CHILDREN’S PRIVACY
Children under the age of 13 are not permitted to use the Online Services. We do not intentionally collect or share personal information about users under the age of 13. In addition, we will not send any direct email offers to users who indicate they are under the age of 13. If we become aware that we have unknowingly collected information about a child under 13 years of age, we will make commercially reasonable efforts to delete such information. If you are the parent or guardian of a child under 13 years of age who has provided us with their personal information, you may contact us using the below information to request that it be deleted.
8. UPDATES TO POLICY
From time to time, we may change this Policy to accommodate new technologies, industry practices, regulatory requirements or for other purposes. The "Last Updated" legend at the top of this page indicates when this page was last revised. Any changes will become effective when we post the revised Policy. If we make material changes to the way in which we use or disclose information we collect, we will use reasonable efforts to notify you (such as by emailing you at the last email address you provided us, by posting notice of such changes on the Services, or by other means consistent with applicable law) and will take additional steps as required by applicable law. This section applies to you only if you are a California resident ("resident" or "residents"). For purposes of this section, references to "personal information" shall include "sensitive personal information," as these terms are defined under the California Consumer Privacy Act ("CCPA").

The specific business or commercial purposes for which we collect your personal information and the categories of sources from which we collect your personal information are described in the sections above "How We Collect Your Information and Use of Your Information." We only use and disclose sensitive personal information for the purposes specified in the CCPA. The criteria we use to determine how long to retain your personal information is described in the section above "Data Security and Retention."
SALES AND SHARING OF PERSONAL INFORMATION
We do not have actual knowledge that we "sell" or "share" (as those terms are defined under the CCPA and used throughout this section) personal information of guests or residents under 16 years of age.
However, we do sell or share certain categories of personal information and, in the past 12 months, we have sold or shared the following categories of personal information about guests or residents: internet or other similar network activity information, such as your information browser and device data, app usage data, data collected through cookies, pixel tags, and other technologies. We sell or share this information with our advertising service providers, who may use it to target advertisements to you online. You can exercise control over the use of these tracking technologies. Rights under the CCPA
If you are a California resident, you may have the rights listed below in relation to personal information that we have collected about you. However, these rights are not absolute, and in certain cases, we may decline your request as permitted by law.
- Request we disclose to you free of charge the following information covering the 12 months preceding your request:
- the categories of personal information about you that we collected, disclosed for a business purpose, sold, or shared;
- the categories of sources from which the personal information was collected;
- the business or commercial purposes for collecting, selling, and sharing personal information about you;
- the categories of third parties to whom the personal information about you was disclosed for a business purpose, sold, or shared; and
- the specific pieces of personal information we collected about you;
- Request we delete personal information we maintain about you, unless the CCPA recognizes an exception;

- Be free from unlawful discrimination for exercising your rights including providing a different level or quality of services or deny goods or services to you when you exercise your rights under the CCPA.

We aim to fulfill all verified requests within 45 days pursuant to the CCPA. If necessary, extensions for an additional 45 days will be accompanied by an explanation for the delay. We may need to collect information from you to verify your identity, such as your name, address, telephone number, and e-mail address, before providing a substantive response to the request. You may designate, in writing or through a power of attorney document, an authorized agent to make requests on your behalf to exercise your rights. Before accepting such a request from an agent, we will require that the agent provide proof you have authorized them to act on your behalf, and we may need you to verify your identity directly with us.
10. ADDITIONAL INFORMATION FOR RESIDENTS OF OTHER U.S. STATES
If you are a California resident, please see the section above, "Additional Information For California Residents," for information on your rights in relation to information that we have collected about you. If you are a resident of another U.S. state, depending on the state you live in, you may have some or all of the rights listed below in relation to information that we have collected about you. However, these rights are not absolute, and in certain cases, we may decline your request as permitted by law, including in the event you reside in a state that does not currently grant you these rights.
- You may have a right to request that we confirm whether we process information about you and give you access to that information in a portable and, to the extent technically feasible, readily usable format that allows you to transmit the information to another business without impediment.
- You may have a right to request that we delete information we maintain about you.
- You may have a right to request that we correct inaccurate information we maintain about you.
- You may have a right to opt-out of the processing of your information for the purposes of targeted advertising, the profiling of your information in furtherance of decisions that produce legal or similarly significant effects, and/or the sale of your information (as all such terms and concepts are defined under applicable law). You may exercise any of these rights by contacting us using the information provided above in "Choices Available to You Regarding Collection, Use and Distribution of Your Information." We will not discriminate against you for exercising any of these rights. We may need to collect information from you to verify your identity, such as your name, address, telephone number, and e-mail address, before providing a substantive response to the request. Depending on your location, you may designate, in writing or through a power of attorney document, an authorized agent to make requests on your behalf to exercise your rights. Before accepting such a request from an agent, we will require that the agent provide proof you have authorized them to act on your behalf, and we may need you to verify your identity directly with us.
In addition, you may have the right to appeal our decision regarding a request related to these rights by contacting us using the information provided below. When you submit a request or launch an appeal, we will limit our collection of your information to only what is necessary to securely fulfil your request or process your appeal. We will not require you or your authorized agent to pay a fee for the verification of your request or appeal.
